Changes to New Hampshire Statutes of Limitations on Civil Sexual Abuse Cases

On June 16, 2020, the New Hampshire state senate passed House Bill 705, reforming a number of issues involving sexual abuse and assault statutes in the state.

Notable changes to the law include:

• Elimination of time limits to file civil sexual abuse claims
• Elimination of certain exceptions regarding sexual abuse/assault offenses for spouses
• New sexual abuse/assault prevention requirements for colleges and universities

Prior to House Bill 705, sexual abuse survivors who were under the age of 18 when the abuse occurred were required to file civil actions within 12 years of the abuse or within three years of the date on which the survivor realized or reasonably could have realized the causal relationship between the abuse and the survivor’s losses and/or damages. Now, however, there is no time limit to file a civil sexual abuse claim against an abuser for acts that occurred prior to the victim’s 18^th birthday—survivors are permitted to file claims at any time.
