New Deadline to File Civil Sexual Abuse Cases in New York

Prior to the New York Child Victims Act, survivors of sexual abuse who were under the age of 18 when the abuse occurred had a very limited amount of time in which they could bring claims against their abusers. In recognition of the fact that survivors often face immense challenges in speaking out about the abuse they suffered, the new law allows individuals to now file civil lawsuits against perpetrators of sexual abuse and the institutions that negligently hired and/or employed them until the age of 55.

Additionally, the Act granted a one-time, one-year window in which sexual abuse survivors who were previously unable to file claims due to the statute of limitations expiring under the old law could now file lawsuits against their abusers. Initially, this one-time window began on August 14, 2019 and ended on August 14, 2020—but due to the current COVID-19 pandemic, the deadline to file a civil sexual abuse lawsuit for individuals who were previously unable to do so has been extended to August 14, 2021.
